SMS TERMS & CONDITIONS

These SMS Terms & Conditions explain how Fortify Property Solutions LLC ("Fortify," "we," "our," or "us") communicates by text message. By voluntarily opting in, you agree to these terms.

1. INTRODUCTION

Fortify may disclose personal data and other information as described below.

• Third parties that help provide the messaging service. We will not share your opt-in to an SMS campaign with a third party for purposes unrelated to supporting you in connection with that campaign. We may share limited personal data with service providers that help us deliver and support text messages, including communications-platform providers, phone companies, and other vendors involved in message delivery.

• Affiliates. We may disclose personal data to our affiliates or subsidiaries when necessary. Their use and disclosure of personal data will remain subject to our Privacy Policy.

• SMS consent information. Text-messaging originator opt-in data and consent will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.

2. PURPOSE OF SMS NOTIFICATIONS

Our SMS notifications are primarily conversational and service-related. Messages may include responses to inquiries, estimate follow-up, appointment or access coordination, scheduling reminders, work-order updates, requests for photos or documentation, estimated arrival times, weather or emergency updates, completion notices, invoice or payment reminders, and customer-support communications.

We will not send unrelated promotional text messages unless you separately provide any consent required by applicable law.

3. OPT-IN, CONSENT, AND MESSAGE FREQUENCY

By providing your phone number and opting in, you confirm that you are the owner or authorized user of the number provided and that you are at least 18 years old. You consent to receive recurring automated or conversational SMS or MMS messages from Fortify regarding your inquiry, scheduled services, active assignments, service updates, and other relevant notifications.

For website submissions, the SMS consent checkbox must be actively selected before the contact form can be submitted and is not preselected. If you do not wish to consent to SMS, you may contact us directly by phone or email. Consent to receive text messages is not a condition of purchasing or receiving services.

Consent may also be documented through an inbound text message, verbal authorization, another written form, or an on-site point-of-service process. Message frequency varies based on your inquiry, active assignment, scheduling needs, and communication preferences. You can generally expect between 1 and 5 messages per week, although frequency may be higher or lower when necessary to coordinate an active service.

4. OPT-OUT INSTRUCTIONS

Your consent is voluntary. You may opt out at any time by replying STOP to any message. We may also recognize END, CANCEL, UNSUBSCRIBE, or QUIT. You may also email help@fortifyps.com with your opt-out request.

After opting out, you may receive one final confirmation message. No further text messages will be sent unless you later provide new consent. Opting out of text messages does not prevent us from communicating through another method when necessary to respond to your request, perform an authorized service, satisfy a contractual obligation, or comply with law.

6. MESSAGE AND DATA RATES, DELIVERY, AND CARRIERS

Standard message and data rates may apply to messages sent to you from us and from you to us. Fortify does not charge a separate fee for text messages. Contact your wireless carrier for information about your plan.

Wireless carriers are not responsible for delayed or undelivered messages. Delivery may be affected by network availability, device settings, carrier filtering, or other circumstances outside our control. Not all carriers or devices support every message feature.

7. PRIVACY AND DATA SECURITY

We use mobile information to manage service inquiries, appointments, project coordination, access, work-status updates, documentation, billing communications, and customer support. We do not sell or rent mobile information.

We do not share personal information with third parties for their independent marketing purposes. We may share limited information with communications-platform providers, wireless carriers, payment or billing providers, and vendors that help us fulfill our contractual obligations, deliver or support the messaging service, or comply with law. Text-messaging originator opt-in data and consent records will not be shared with third parties or affiliates for marketing or promotional purposes.

We use reasonable administrative, technical, and organizational measures to protect personal information. However, no electronic transmission or storage system can be guaranteed to be completely secure.

8. DATA RETENTION

We retain personal information, including consent and messaging records, only for as long as reasonably necessary to fulfill the purposes for which it was collected and to satisfy legal, accounting, contractual, or reporting requirements. When information is no longer required, it will be deleted, anonymized, or securely disposed of in accordance with applicable practices.

9. COMPLIANCE WITH REGULATIONS

We strive to comply with applicable text-messaging laws and industry standards, including the Telephone Consumer Protection Act (TCPA) and relevant CTIA guidelines. Our practices are designed to provide clear consent disclosures and straightforward methods for obtaining help or opting out.

10. INDEMNIFICATION AND NUMBER RESPONSIBILITY

You agree to indemnify, defend, and hold Fortify harmless from claims arising from your voluntary provision of a telephone number that you do not own or have authority to use, or from your failure to notify us of a change, transfer, or deactivation of your mobile number, to the extent permitted by applicable law.

If you change, transfer, or deactivate your mobile number, please notify us promptly or reply STOP before the change when possible.

11. PARTICIPATION REQUIREMENTS

To participate in our SMS notification service, you must:

• Be 18 years of age or older.

• Own or be authorized to use a wireless device capable of two-way messaging.

• Subscribe to a wireless service with text-messaging capabilities.

Not all mobile carriers support every aspect of the service.

12. DISPUTE RESOLUTION AND ARBITRATION

To the extent permitted by applicable law, you agree to resolve disputes relating to the SMS notification service on an individual basis and not as part of a class or representative action. You waive the right to a jury trial and agree that covered claims will be resolved through final and binding arbitration. If you do not agree to this section, do not participate in the SMS service.

13. MISCELLANEOUS AND CHANGES

You represent that you have the rights, power, and authority necessary to agree to these terms and that your participation does not violate another contract or obligation. If any provision is found unenforceable or invalid, the remaining provisions will remain in full force and effect.

We may update these terms to reflect changes in our services, practices, or legal requirements. Updates will be posted on this page with a revised effective date and may also be communicated by SMS or email. Continued participation after an update constitutes acceptance of the revised terms to the extent permitted by law.
